Boerne adopted Ordinance No. 2023-09 on 8 August 2023, creating Chapter 23, “Short Term Rentals,” of the city code. It makes it unlawful for any person or entity to rent, or offer to rent, any short-term rental without a valid registration and permit. A short-term rental is a property listed as available for 30 days or fewer, and the rules reach both the city limits and the extraterritorial jurisdiction.
Registration is $200 and a permit runs two years, with a $200 renewal and a $100 inspection fee inside the city limits. In residential zones no short-term rental may operate within 200 feet of another on the same block face, measured property line to property line. You must also register with the finance department for hotel occupancy tax before the permit is approved. Boerne’s city hotel occupancy tax rate is 7 percent on top of the state’s 6 percent.
Texas Property Code 92.103 gives a Boerne owner one deadline that matters: refund the security deposit on or before the 30th day after the date the tenant surrenders the premises. Section 92.109 supplies the teeth. Miss that 30th day without either returning the deposit or delivering a written description and itemization of deductions, and you are presumed to have acted in bad faith.
A landlord who in bad faith retains a deposit is liable for $100, three times the portion wrongfully withheld, and the tenant’s reasonable attorney’s fees — and once the tenant sues, the burden of proving the retention was reasonable sits with you, not with them. One more trap: if your lease conditions the refund on advance notice of intent to vacate, that clause is only enforceable when it is underlined or printed in conspicuous bold print.

Our current average time is 14-21 days but depending on price and location it can be anywhere between 3-20 days in general.
Tenants will submit their request via their online account. Our platform will automatically send out bid requests from our extensive vendor network. We will surface the bid to you for your approval and then coordinate with the vendor and tenant to get the issue resolved.
To date we have done on-demand without any major issues. We carry an additional $50k in liability insurance to cover any damages, beyond your coverage, that may occur. Should a key go missing, we will have the locks rekeyed at our cost.
Depends on the location of the property. But at the very least, it needs to be free of clutter and trash, it needs to have been professionally cleaned or cleaned to that quality. Flooring and paint go a long way in making a rental feel refreshed.
We can usually schedule to come out to take photos, do a walk-through and take keys within 24-48 hours. We prefer to take photos when the property is completely empty and move-in ready and can generally get a listing online within 24-48 hours of taking photos.
