Milwaukie Municipal Code Chapter 5.60 provides that a landlord may terminate a rental agreement without a cause specified in the Act only by delivering written notice of “not less than 90 days before the termination designated in that notice. or the time period designated in the rental agreement, whichever is longer.” ORS 90.427 allows 30 days in the first year of occupancy; inside Milwaukie, 90 days is the floor throughout.
Two exemptions apply: week-to-week tenancies, and a unit where the landlord’s primary residence is in the same building or property containing no more than two dwelling units. A landlord who gets it wrong is liable for up to three months’ rent plus actual damages, reasonable attorney fees and costs.
Oregon’s deposit rules are tighter than most owners expect, and the penalty is doubling rather than forfeiture. Under ORS 90.300 a landlord must return the security deposit and deliver a written accounting stating the basis of any claim no later than 31 days after the tenancy terminates and the tenant delivers possession. A tenant may recover twice the amount that was wrongfully withheld or withheld in bad faith, or withheld without the required accounting.
The statute also limits the deposit itself: no new or increased deposit may be required during the first year, except by agreement for a change such as adding a pet, and after that an increase needs three months’ notice. Carpet cleaning may only be deducted where specialized equipment is used, the carpet was cleaned after the previous tenant, and the rental agreement expressly allows it.
