Douglasville has run a foreclosed and vacant property registry since the ordinance took effect on 1 November 2012, and the Code Compliance division maintains it. O.C.G.A. 44-7-13(a) has long said “the landlord shall keep the premises in repair.” House Bill 404, the Safe at Home Act, added subsection (b) effective 1 July 2024: every contract, lease or similar agreement for the use of real property as a dwelling place “is deemed to include a provision that the premises is fit for human habitation.” It applies to residential leases entered into or renewed on or after that date, so almost every Douglasville lease now carries it, and no lease language opts out of a term the statute deems included. The same act added the two-month deposit cap at 44-7-30.1 and, at 44-7-50(c), a requirement that before filing a dispossessory for nonpayment you give the tenant notice to pay all past-due rent, late fees, utilities and other charges — or vacate — within three business days.
